Topic 1: Gain insight from Robert Kennaley (specialist in construction law having worked in the industry for 15 years before his call to the Bar almost 30 years ago) and Rachel Prestayko (Associate Lawyer practicing exclusively in construction law) from Kennaley Construction Law on the good, the bad and the ugly of soon to be implemented Construction Act changes. 

Significant changes to the Construction Act are set to come into force at some point in early 2025.  Holdback will have to be released on an annual basis, imposing significant administrative burdens on some and increasing the likelihood and need for ‘mid-project liens’ for others.  Payers will no longer be able to backcharge against holdback once it becomes payable, imposing very significant impacts for construction industry participants in an extremely important change which goes against the previously stated intentions of the Act.  Also, prompt payment changes will alter both the obligations of payers and the entitlements of payees, in ways that need to be understood if payment issues are to be managed properly.  Finally, access to adjudication is being expanded in ways that will give parties more dispute resolution options, but also make adjudication more lengthy and costly in some cases.  In this seminar, lawyers from Kennaley Construction Law will introduce these and other changes, providing practical guidance on how the changes can be managed to meet your obligations under, and take advantage of, the evolving legislation
